Terms and conditions

1. General details of Competition and prize draw
  1. The following rules (“Rules”) apply to Ear of the Underground Competition ("the Competition") which will run each weekday from 28TH January 2008 until 21st February 2008 ("the Duration").
  2. The Competition is promoted by (“ The Promoters”) thelondonpaper (NI Free Newspapers Limited) and Capital 95.8 (GCAP Media plc).
  3. The aim of the Competition is to find London Underground’s top Busker as voted for by listeners to Capital 95.8 (“Voters”) and readers of thelondonpaper. Voters will only be able to submit one vote per day, each day of the Duration.
  4. Any Busker and/or Voter who participates in the Competition will be deemed to have understood these Rules along with the Terms and Conditions and to be bound by them.
  5. The Promoters reserve the right to change, amend or cancel the Competition at any time.
  6. Any data submitted by participants to Buskear.com (“the Website”) will be used for the sole purposes of this Competition.
2. Rules of entry for the Competition – Buskers
  1. Buskers licensed with London Underground will be invited to enter into the Competition. Buskers must be fully registered on the Website by 27th January 2008 in order to participate. Any Busker who has registered by this date will be included in the Competition.
  2. There will be 4 weeks of voting, with voting closing at 9pm on Thursday 21st February 2008.
  3. Voting will commence at 9AM on Monday 28th January. During the first 2 weeks of the competition all buskers will be eligible to receive votes.
  4. At the end of Week 2 of the Duration (Friday 8th February 2008) the 10 Buskers who have received the most votes will go forward into the 3rd week of voting (“the Shortlist”).
  5. At the end of Week 3 of the Duration (Friday 15th February 2008) the 2 Buskers from the Shortlist who have received the most votes will go forward into the final week of voting (“the Finalists”).
  6. The Finalist to receive the most votes at the end of the fourth week of the Duration will be chosen as the winner of the Competition (“the Winner”) live on air on Capital 95.8 at 9pm on Thursday 21st February 2008.
  7. The Winner’s name will also be published in thelondonpaper the following day and on Buskear.com thereafter.
  8. The Winner will receive a cash prize of £5000 (five thousand pound) and be invited to be the opening act for a Capitalive gig (to be determined at the sole discretion of Capital 95.8).
  9. Buskers must be available for an allotted time on the 9th or 10th February to attend a recording session at Capital Radio should they get through to the shortlist.
  10. Buskers must also be available to attend the final on the evening of 21st February at Capital Radio should they reach the finals.
  11. By entering this Competition the Buskers give permission for any material that is submitted to Buskear.com, or audio that is produced at Capital Radio to be used publicly at the Promoters’ discretion.
  12. By entering this competition the competitors give permission for the promoter’s to use details of the entrants (including but not limited to name, general location and photographs) for the purposes of publicity at their discretion.
  13. The Promoters reserve the right at any time to cancel, modify or supersede the competition (including altering prizes) if, in their sole discretion, a competition is not capable for being conducted as specified. The Promoters reserve the right to substitute a prize of equal value in the event that circumstances beyond their control make this unavoidable.
3. Rules of entry for the daily Prize Draw – Voters
  1. Throughout the Duration, Buskear.com Voters will be able to vote for their favourite Busker each weekday and as a result be automatically entered into a prize draw.
  2. Each Voter must be fully registered with Buskear.com to participate.
  3. Voters must provide contact details and a telephone number to be included into the prize draw.
  4. Any votes submitted between 9pm on a Friday and 12 midnight on a Sunday will be entered on the following Monday.
  5. Once the Voter’s vote has been logged, the Voter must to listen to Capital 95.8 during Lucio’s show that evening (from 7 -10pm) and pick up a copy of the next day’s edition of thelondonpaper to find out if they have won a prize.
  6. At 9pm each day of the Duration, a shortlist of 50 Voters will be generated randomly from the pool of Voters who have voted during that day.
  7. From this list Capital will contact Voters in descending order as stipulated on the list. The first selected Voter who is available immediately to claim their prize On Air will win.
  8. Subsequently the next Voter on the randomly generated list will be supplied to thelondonpaper. This winner’s name will be published in the following day’s edition of thelondonpaper. The winning voter will be advised to call the number indicated to claim their prize.
  9. Voters must be available to answer the telephone between 9-10pm that evening as one of the two winners will be contacted live on air.
  10. The closing date for all votes/entry into the daily prize draws will be 9pm on Thursday 21st February.
  11. Voters must be aged18 and above.
  12. Employees and family members of NI Free Newspapers Limited, GCAP Media PLC, DLKW or anyone professionally with the promotion are not eligible to enter the prize draw.
  13. Prizes will be specified each day. No cash alternative will be offered. The Promoters reserve the right at any time to cancel, modify or supersede the competition (including altering prizes) if, in their sole discretion, a competition is not capable for being conducted as specified. The Promoters reserve the right to substitute a prize of equal value in the event that circumstances beyond their control make this unavoidable.
  14. By entering into this prize draw the entrants give permission for the promoters to use details of the winner (including but not limited to name, general location and photographs) for the purposes of publicity at their discretion.
